A WOMAN who was being held in a custody cell has been sentenced after she threatened to put a person's head down a toilet.

Sophie Davis, 30, admitted counts of common assault, assault by beating of an emergency worker and common assault of an emergency worker when she appeared at South Cumbria Magistrates’ Court on November 13.

The court heard she had been arrested and taken to Barrow police station on October 13 this year where a woman, trained as an appropriate adult to attend the police station, was trying to speak to her.

Prosecutor Lee Dacre said: “The defendant was verbally aggressive to the woman and threatened: ‘I will put your head down the toilet’.

“The defendant then launched from the mattress towards the woman. It caused her to believe she was going to be assaulted.”

Officers were called to attend when Davis then scratched Police Sergeant Nield to the chest with her left hand before spitting toward Police Constable Thomas.

In mitigation, Karen Templeton said the offences were ‘very much out of character’ for her client.

Ms Templeton added: “No further action was taken in regards for the matter she was originally arrested for.

“She accepts she was reckless in her actions and is very sorry about what has happened.

“She is a woman with mental health problems and felt very frustrated at the time. This was an isolated incident.”

The court was told Davis had no previous convictions.

Magistrates fined Davis, of Hoghton Close, Lytham, £480 for the offences.

Davis was also ordered to pay a surcharge of £192 and court costs of £85.

No order for compensation was made.
